Conditions of participation - Advent calendar 2022
Participation
Participation in the online Advent calendar of ElevateX GmbH, hereinafter referred to as the competition, is free of charge and without obligation. Participation takes place online at the web address https://elevatex.de/advent-calendar-2022/.
All freelancers (as defined in the German Income Tax Act (EstG § 18)) who have reached the age of 18 and are permanently resident in Germany at the time of participation are eligible to participate. Legal representatives are excluded from participation. Persons who have been excluded from the competition by ElevateX GmbH and employees of ElevateX GmbH are also not eligible to enter.
By entering the competition, the participant agrees to the terms and conditions and the privacy policy of ElevateX GmbH.
The competition begins on December 1st, 2022, at 00:01 AM and ends automatically on December 24th, 2022, at 11:59 PM. On all days within the period from December 1st, 2022, to December 24th, 2022, participants will be given the opportunity to open an Advent calendar door online.
Competition Rules and Mechanics
Only the door of the respective day can be opened – e.g., the 12th door on December 12th, 2022, the 13th door on December 13th, 2022, etc.
There is no guarantee of winning. Multiple participation, for example under a pseudonym or other e-mail addresses, is excluded and will result in exclusion from the competition.
Each participant can open a door every day during the period of the competition and thus has a chance to win the daily prize. A double win on one day is excluded. Each participant can win only one prize during the period of the competition.
An exception to this is door 24: on December 24th, 2022, all participants of the competition (independent of the day they participated) will be entered into the draw for the main prize. At most one can win a single daily prize and the main prize.
The winners will be determined at random, excluding the public, on the following day a door was opened the earliest but no later than January 5th, 2023.
Prize Winning
The prize will be shipped / emailed exclusively to the winner.
Each winner will be informed via e-mail to the e-mail address provided. The winner will have five business days from the date of notification to accept the prize. The acceptance is done by sending the correct shipping details to ElevateX GmbH (to info@elevatex.de) in time. In the message, the full delivery address must be mentioned, and the winner’s e-mail address has to be confirmed.
The prize will be sent to the address provided by the participant.
If the prize is not accepted in time, the claim to the prize will be forfeited without compensation. Should a prize be returned due to incorrect address data or non-collection (in case of storage by the delivery provider), the claim to the prize will be forfeited without replacement and a new winner will be determined by a new draw.
ElevateX GmbH is not liable for any damage caused during transport by the logistics company. A cash payment is excluded. The prize will be awarded exclusively as a non-cash prize. An exchange of the prize is not possible.
Data protection
In the event of a win, the winner will be contacted via the e-mail address provided by the means of form entry. It is necessary to obtain the following data of the participant via the e-mail address: first name, last name, street, postal code, city.
All personal data will be treated confidentially. Your data will not be passed on to third parties for advertising purposes. The participant can request the correction, deletion and blocking of his data at any time.
By participating in the competition, the winner automatically agrees that his first name will be publicly mentioned on the ElevateX website and social media channels of ElevateX. After being notified by ElevateX about his win, the winner can object to this naming. In this case, the public mention of his first name will be waived. This has no effect on the shipment of the prize.

Disqualification from the advent calendar competition
ElevateX GmbH is entitled to disqualify individual participants from the competition if there are justified reasons, such as violation of the conditions of participation, influencing the competition, manipulation, etc.
Legal process
Legal recourse is excluded. There is no enforceable claim to the payment of the winnings. The online Advent calendar competition of ElevateX GmbH is subject exclusively to the laws of the Federal Republic of Germany.
Changes to the conditions of participation and termination of the competition
ElevateX GmbH reserves the right to change the conditions of participation at any time. Furthermore, ElevateX GmbH reserves the right to terminate or suspend the competition at any time. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.
Limitations of liability
ElevateX GmbH excludes liability for faulty data transport and/or loss. ElevateX GmbH shall not be liable in particular in cases where data is not transmitted to ElevateX GmbH or not transmitted in time due to incorrect and/or incomplete data entry on the part of the participant.
